The state High Court has given a big relief to Shastri degree holders by declaring the mandatory B.Ed for the posts of Shastri teachers as illegal. Justice Ajay Mohan Goyal, while disposing of the petitions challenging the condition of B.Ed for Shastri teachers, said that the government cannot take arbitrary decisions without proper procedure and amendment in the recruitment and promotion rules.
The High Court clarified that an amendment in the rules is necessary to fix the mandatory B.Ed in the recruitment of Shastri teachers. The petitioners had challenged the notification issued by the Education Department for Shastri posts in 2023, in which a B.Ed degree was stated to be mandatory. He argued that this condition was implemented without changing the recruitment rules, which would lead to inequality in the recruitment process.
The applicants also argued that by implementing the mandatory B.Ed degree, junior candidates doing Shastri and B.Ed can be appointed after them. This will violate the principles of batch-wise recruitment.
Earlier, the division bench of the High Court had dismissed the petitions challenging the notification of 19 February 2020. But this time the single bench ruled in favor of the applicants. This decision will require the government to ensure transparency in the recruitment process and amend the rules for Shastri teachers.
