A company’s plea concerning the site development plan for the bulk medicine project being built in Haroli, the seat of Himachal Deputy Chief Minister Mukesh Agnihotri, has been denied. The site development plan, road, boundary wall, and bridge are all part of the Rs 1924 crore project, which would also cost Rs 287 crore to build. In this respect, New India Contractor and Developers Private Limited Company has petitioned the High Court.
The company’s case was denied by the division bench of Justice Tarlok Singh Chauhan, a senior judge of the High Court, and Justice Sushil Kukreja. Actually, until the applicant business’s technical proposal was accepted online, the aforementioned corporation had asked that the bids for the site development work not be opened. The company’s plea in this respect was denied by the High Court. The identical petition was previously denied by the High Court on May 4. The High Court then declared that this petition, which was just submitted on June 3, was obviously late because the offer had already been completed and the technical bids were being reviewed.
Since this is a time-bound project, the High Court had stated that examining this petition at this time would cause the entire contract process to be delayed. The applicant business then appealed the High Court’s ruling to the Supreme Court. The Supreme Court ordered the High Court to reexamine the case on its merits in a June 20 ruling. In addition, before the High Court’s ruling, the Supreme Court had prohibited the opening of financial bids for this project, which totaled Rs 287 crore.
Following this Supreme Court order, the High Court once more rendered a decision based on merit and denied the petition of the applicant company, rejecting the applicant’s arguments that he had brought up the technical error, stating that the bid was uploaded incorrectly by the company itself and that the respondent, Himachal Pradesh State Industrial Development Corporation Limited, was not responsible for the irregularity. Because of this, the petitioner has no grounds for complaint.
The applicant business claimed that even though it had timely deposited the earnest money of Rs 2 crore 98 lakh, it was unable to upload its technical tender because of technical issues on the side of the respondents. However, the responders denied receiving the earnest money and claimed that they had not had any technical difficulties.
It is important to note that the bulk medication endeavor is a big undertaking. In the pharmaceutical industry, Himachal is now leading Asia. Himachal will emerge as the world’s top pharmaceutical area at the completion of this project. On March 21, 2020, the Bulk Drug Park project in Haroli, Una district, was authorized by the Narendra Modi administration at the Center. This project is expected to cost Rs 1924 crore in total. The Center will give Rs 1118 crore as a grant out of this total.
