Hearing in Sanjauli Masjid case, decision on stay of demolition of mosque will be taken on November 11

Shimla, November 06: Muslim organizations have challenged the Municipal Corporation Court’s orders to demolish three floors of Sanjauli illegal mosque in the capital in the District Additional Sessions Court, Shimla. A stay has been sought on the orders to demolish the mosque. The hearing on the petition of Nazakat Ali Hashmi filed on behalf of Muslim organizations was held in the court of Shimla Additional District Sessions Judge Praveen Garg. After hearing all the parties, the court has fixed the next hearing of the case on November 11, in which the decision on maintenance and stay of the petition will be taken.

Vishwa Bhushan, advocate of petitioner Nazakat Ali Hashmi on behalf of Muslim organizations, said that in the Sanjauli Masjid case, a mosque committee has given a written memorandum to the Municipal Corporation Commissioner to demolish the mosque, on the basis of which the Municipal Corporation Court has given its decision. But the mosque committee which has given this memorandum is illegal.
In such a situation, the memorandum given to demolish the mosque is also illegal. The mosque has been built on the land of Waqf Board and the religious sentiments of Muslim organizations have also been hurt. Therefore, a stay has been sought from the court in the case. The court has not given a stay at present but considering the seriousness of the matter, it has said that it will give its decision on the petition on November 11.
Advocate Jagat Pal, appearing for the local people of Sanjauli in the case, said that there is no justification in the petition of Nazakat Ali Hashmi because neither the petitioner is a local resident nor is there any stakeholder of this mosque. In such circumstances this petition does not stand. The Mosque Committee had given a memorandum to the Municipal Corporation Commissioner to demolish the mosque with the consent of the Waqf Board, on which the Municipal Corporation Court has given its decision
