The High Court has stayed the filing of a charge sheet in a case related to the death of Chief Engineer Vimal Negi. The court has clarified that chargesheet should not be filed against the accused in the case without the permission of the High Court. Judge Ajay Mohan Goyal said that he will personally study the fact-finding report presented in a sealed cover by the Additional Chief Secretary Home before the next hearing of the case and issued orders to continue the next hearing on Wednesday as well. The ACS report was sought on behalf of Vimal Negi’s wife.
The government opposed handing over the ACS report to the applicant and said that this report is yet to be seen by the government; hence, this report should not be handed over to the applicant at present. On this, the court said that the decision to hand over the ACS report to the applicant will be taken tomorrow. However, the court ordered copies of the separate status reports presented in the court by the DGP and SP to the complainant and the Advocate General.
The Advocate General, on behalf of the government, clarified that he has nothing to hide in this case. It is noteworthy that after the preliminary hearing of the petition filed by Vimal Negi’s wife, Kiran Negi demanding a fair investigation, the respondents were ordered to file a status report.
The petitioner, being dissatisfied with the SIT investigation so far, has demanded that the High Court issue an order handing over the investigation to the CBI to ensure a fair investigation of the case related to this death. After Negi’s disappearance, his wife wrote a letter to the chief minister and accused Power Corporation MD Harikesh Meena and Director Desraj and other high officials of harassing her husband.
