The Himachal Pradesh High Court has raised questions on the temporary arrangement of the government and the rules being flouted regarding outsourced recruitments. The division bench of Acting Chief Justice Tarlok Singh Chauhan and Justice Satyen Vaidya has asked the government whether a company selling phenyl can recruit nurses. The government has not made any parameters and rules for this.
A petition has been filed in the High Court by JK Enterprises on the parameters under which the work is given to the company and whether there is transparency. The government has filed its reply on this, on which the court expressed displeasure. The hearing of this case will be held on December 31. The company has alleged that the corporation has fixed a 5 percent commission, from which 2.5 percent each goes to the corporation and the companies. Due to this, the companies have lost the right to financial auction. The corporation empanels the companies, after which the department sends recommendations to the corporation. If the work requires less than 10 people, then the companies are given work under rotation.
If it is more than that, then there are no rules. For that, a technical auction is done. If the name of a company is recommended by the department, then the work is given to that company. The corporation has selected 36 companies, through which the work of the departments is outsourced. The corporation takes Rs 50,000 from each of them.
The outsourcing process has been started in Himachal Pradesh under the Financial Rules 2009, under which there should be an advisory board, registration, license, and notification, while Himachal Pradesh Corporation is doing outsourcing recruitments bypassing all these rules.
The government filed an application in the High Court to remove the ban on outsourcing recruitments.

The Advocate General told the court that the government is considering the formation of a committee for the process of outsourcing recruitments. The state government will oversee this committee, which will bring transparency to the recruitment process. The application filed by the government will now be heard on December 31.

On November 7, the court had banned all recruitments being done in the departments by the Electronics Corporation. The division bench has given instructions to upload all the data of companies and candidates on the website. The petitioner has alleged that about 110 companies have been found fake in the state. No rules have been made for the recruitment process. Under the Center’s policy, only class IV posts are outsourced, whereas in Himachal Pradesh, class III posts are also being outsourced.
