The Himachal Pradesh High Court has granted Shimla SP Sanjeev Gandhi, who is on leave, a small reprieve. Regarding some remarks made in the orders issued by the single bench on May 23, the court has granted relief. While acknowledging that SP Sanjeev Gandhi and other SIT members’ personal and professional reputations shouldn’t be damaged, the court made it clear that they weren’t given a chance to fully argue their case.
The court acknowledged that the relevant officials were not given the chance to provide a detailed explanation of the SIT’s investigation report. It is important to remember that the High Court will only consider a portion of the LPA.
The court, however, declined to get involved and upheld the directive to turn over the case to the CBI. Additionally, the High Court stated that it had taken note of and would take into consideration the remarks made by the single bench.
A divided bench consisting of Chief Justice Gurmeet Singh Sandhewalia and Justice Ranjan Sharma heard the appeal of Sanjeev Gandhi of Shimla, who is currently on leave, contesting the directives to turn over the inquiry of Vimal Negi’s death to the CBI. In his own capacity, Sanjeev Gandhi appealed the May 23 ruling of a single High Court panel in a Letters Patent Appeal (LPA).
