In a rare case from the Theog subdivision of Shimla district in Himachal Pradesh, two 75-year-old women have been granted divorce from their younger husbands after mutually deciding to live separately. The petitions were jointly filed by the couples in the Family Court of Shimla and were accepted by the court.
In the first case, a 75-year-old woman and her 59-year-old husband filed a joint petition stating that they were married in 1990 and had no children from the marriage. According to the petition, serious differences arose between them in 2010. Despite efforts by respected members of society to resolve the dispute, reconciliation was not possible. Both parties agreed that their marriage should be dissolved and therefore approached the court. After reviewing the matter, the court granted the divorce.
In the second case, a 75-year-old woman and her 39-year-old husband sought divorce after being married in 2008. The couple has three children. Their petition stated that due to differences that arose in June 2021, they had been living separately since then. As their dispute could not be resolved, both informed the court that they no longer wished to continue the marital relationship.
After examining the case, the court concluded that reconciliation between the parties was not possible and approved the divorce. It was agreed that the three children would live with their father, while he would allow them to meet their mother.
As part of the settlement, the husband will provide the divorced wife with a room, kitchen, and bathroom for accommodation. In another affidavit submitted to the court, the 59-year-old husband agreed to pay ₹5,000 per month from his pension as maintenance to his former wife. He also committed to bearing the cost of primary medical treatment whenever she falls ill.
