Now, the recruitment of police constables and head constables in Himachal Pradesh will be done under the state cadre, which will make the police recruitment process in the state more integrated and organized. The Himachal Pradesh Police Amendment Bill, 2024, passed in the winter session of the Himachal Legislative Assembly held in Tapovan, has been notified in the gazette after getting the approval of the President.
It is now clear that the appointment of non-gazetted police officers (grade two) will be done through the Police Recruitment Board. It mainly includes the posts of constable and head constable. This provision has been implemented in the state cadre to ensure equality and control at the state level in the deployment and training of the police force.
This bill was sent to the president for approval by Governor Shiv Pratap Shukla due to the provisions related to the Concurrent List. Now after the approval, Principal Secretary (Law) Sharad Kumar Lagwal has issued the notification.
In the new amendment, a major change has been made in subsection-3 of section 65, under which the arrest of public servants deployed on government duty can now be done only with the prior permission of the government. This step has been taken with the aim of giving legal security to public servants so that they can work without fear.
Apart from this, flexibility has also been brought regarding appointments in the District Police Complaints Authorities. Till now only retired superintendents of police, district attorneys, additional district judges, or officers above him were nominated in it, but now if such senior officers are not available, the state government will also be able to nominate junior retired officers.
This amendment will ensure improvement, stability, and transparency in the police administrative system. This will strengthen the law and order system of the state and the recruitment process will be more organized.
