Himachal Pradesh government has got a big relief from the Supreme Court in the CPS case. The former CPS MLA will continue on his post. As per the order of the Supreme Court, MLAs who are CPS will not be disqualified. Paragraph 50 of the High Court’s decision will not apply to these. The apex court has given two weeks’ notice to the state government in the matter. The next hearing of the case in the Supreme Court will be on January 20. Let us tell you that different petitions related to the CPS law of Himachal Pradesh were heard in the Supreme Court. Senior advocates Kapil Sibal and Abhishek Manu Singhvi are representing the Himachal government in the case.

In all the petitions, the November 13 decision of the Himachal High Court has been challenged. The High Court has declared Himachal Pradesh’s 18 year old CPS Act 2006 as illegal and unconstitutionalAfter the decision of the High Court, six MLAs Sanjay Awasthi from Arki, Ram Kumar Chaudhary from Doon, Ashish Butel from Palampur, Mohan Lal Brakta from Rohru, Kishori Lal from Baijnath and Sundar Singh Thakur from Kullu had to step down from the post of Chief Parliamentary Secretary.
In the petitions filed by the government in the apex court, it has been said that the posts of Chief Parliamentary Secretary and Parliamentary Secretary have been in existence in India for 70 years and in Himachal for 18 years. It has been argued in the petition that the Himachal government had appointed CPS for good governance and public interest works.
