Himachal Pradesh High Court has put a stay on the notification issued by the state government, which included a provision for financial recovery from the employees benefiting from seniority during the contract service period. The matter was heard in the High Court by a division bench of Justices Tarlok Singh Chauhan and Sushil Kukreja. The court has suspended this notification for the time being, which has provided relief to thousands of employees.
The state government had issued a notification on February 20, 2024, deciding to withdraw the benefits of salary, seniority, and promotion and to make financial recovery from those employees whose services were regularized after December 12, 2003. This order from the government was applicable to those cases where the employees were granted the benefit of seniority during the contract service period based on the orders of the High Court and the Supreme Court.
The employees had filed a petition in the High Court against this decision of the government. During the hearing of the case, the court stayed the government’s notification, terming it unfair. This will now provide relief to those employees who had received the benefit of seniority during the contract service period.
