The state High Court has refused to stay its stay order in the case related to filling nurses’ posts on outsource. A division bench of Chief Justice Gurmeet Singh Sandhawalia and Satyen Vaidya rejected the government’s application seeking a stay on the stay order. The court said that nurses are being appointed on an outsourced basis by completely ignoring the recruitment and promotion rules made for their recruitment. They are not being appointed judiciously.
It is worth noting that during the last hearing, the High Court had said in this case that there are names of 36 such contractors who have been approved by H.P. State Electronic Development Corporation. The court had said that prima facie, looking at the list, it appears that many of them have nothing to do with recruitments, and they have never handled any recruitment case. Leave alone, there may be cases where the owners of these firms themselves are completely illiterate or semi-literate, but surprisingly they have been entrusted with the task of recruiting on an outsourced basis for responsible posts like law officers, nurses, doctors, etc. Through the reply filed on behalf of the applicant, the court was informed that the posts of nurses have not been filled as per the recruitment and promotion rules for a long time. At present, a decision has been taken by the state government to fill 28 posts. The High Court had clarified that it has been completely decided that even the recruitments made on a stopgap arrangement cannot be in accordance with the recruitment and promotion rules to some extent done as per the law.
